Mindario Privacy Policy

Your information privacy and security is very important to us. Policies in this document let you know what happens to your personal data that you give to us, and what personal information we may collect from you when you use our service and mobile application referred to as “Mindario”. This document also describes how you find out what information we have collected from you and how to stop us from collecting or using your data.

1. What are your data protection rights?

Here is a list of the rights that everyone who uses the Service has under data protection laws:

• The right to have your personal information corrected if it is inaccurate and to have incomplete personal information completed

2. Your right to object

You have the right to object to certain uses of your data, in particular to data we may use for direct marketing or other uses of your data that serves our business interests. You can contact us by sending an email to support@mindario.com or by going to the Contact Us section of our website

3. What personal information do we collect from you?

We collect the communications and other information you submit to us like content (text and photos), and also other information that may be sent to us when you use our Service. Specifically:

• Account sign up information—your name, email address, and the company that sponsors your access to the Service (if applicable)
• “Content” you record or post, such as journaling or any other writing or recording activities including recording your voice and/or video (if available)
• Messages you communicate with us or with others from within the service
• Information contained in the content you post. This can include special tags that come with the photos or ‘metadata’, such as the location of a photo, date the photo was taken or the date a file was created.
• The products and services you have used, looked at or have clicked on
• Device information: We collect information about the computer or mobile device you use to access the Service, including the hardware used (like what kind of phone or computer you are using), operating system and version, unique device identifiers and mobile network information (like your mobile carrier you use to access the service).
• Log Information: We log information about your use of the Service, including the type of browser you use, access times, pages viewed, your IP address and the page you visited before navigating to our Service.
• Information collected through cookies and/or via tracking as you use the site. We use various technologies to collect information on your use of our Services which may include sending cookies to your computer or mobile device. The purpose of this cookie is to identify you when you use the Service so that we can enhance and customize your experience. • We may also collect information via “tracking pixels”. Tracking pixels are electronic images that may be used in our Service or emails and help deliver cookies, count visits, understand usage and marketing or email campaign effectiveness and determine whether an email has been opened and acted upon.
• Sometimes our computers may automatically process content you and others provide to analyze context and what's in them for the purposes described below.

4. How do we use your personal information?

We use the information we gather about you to:

5. Who do we share your personal information with?

We may share your personal information with the following third parties for the purposes mentioned:

• Mindario service providers or business partners such as wellness consulting firms, insurance groups, companies, or brokers, employers and account beneficiaries, or with others who are a part of providing your products and services or operating our business
• Governmental and regulatory bodies
• Our IT service providers such as public cloud infrastructure providers, IT software, and maintenance or data backup providers
• Market research organizations and academic research organizations who help us to develop and improve our products and services

We don't share the specific content you provide to the Service with these third parties, including your journal entries or data about your individual usage patterns. Instead, we make every effort to share only aggregate, non-identifiable information with these third parties, unless compelled to otherwise by a lawful court order or subpoena.

6. Do you have to provide your personal information to us?

We’re unable to provide you with our Service if you do not provide certain information to us. In cases where providing personal information is optional, we will tell you and make this clear

7. Do we monitor any of your personal information?

Yes. Monitoring means: Listening to, recording of, viewing of, intercepting of, or taking and keeping records of communications, email, text messages, social media messages, or other communications.

We may monitor where permitted by law and we’ll do this where the law requires it, or to comply with regulatory rules, to prevent or detect crime, in the interests of protecting the security of our communications systems and procedures and for quality control and staff training purposes. This information may be shared for the purposes described above

8. Your Choices – How you can manage or delete your information

Account. You may delete, deactivate or edit your account settings, including your privacy setting information by emailing us at support@mindario.com. Note:  We may retain certain information as required by law or for legitimate business purposes.

Marketing. You may opt out of receiving marketing and promotional emails and text messages from Mindario by following the ‘Unsubscribe” instructions in those messages. Please note that if you opt out, we may still send you transactional or relationship messages, such as those about your account or our ongoing business until you delete your account.

Cookies. Most web browsers are set to accept cookies by default. If you prefer, you can usually set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of the Services provided.

Tracking. We may allow others to provide analytics services on our behalf and when agreed by you the user, to serve advertisements to you on our behalf. These entities may use cookies, web tracking (beacons) and other technologies to collect information about your use of the Services and other websites. This information may be used by Mindario and others, to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising targeted to your interests and better understand your online activity. Social Sharing. Our Service includes social sharing features to be used with common social networks. Social sharing features are provided by third-party services that may implement their own cookies and/or tracking. The use of Social Sharing enables the sharing of your information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing service. 9. Is your personal information transferred between countries?

At this time, all data in the Services is stored in the United States of America. As such, the Services are not intended for use by nationals covered by GDPR.

10.  Do we do any automated decision making on your data?

We sometimes make decisions about you using only technology, where none of our employees or any other individuals have been involved. For instance, we may do this to decide whether to offer you a product or service and the price we will offer the Service to you.

11. For how long is your personal information retained?

Unless we tell you otherwise, we’ll hold your personal information based on the following criteria:

• For as long as we have reasonable business needs, such as managing our relationship with you and managing our operations
• For as long as we provide goods and/or services to you and then for as long as someone could bring a claim against us; and/or
• Retention periods in line with legal and regulatory requirements or guidance

12. You Can Decide What Communications You Receive

From time to time Mindario may send you email messages or other forms of marketing communications describing new services, new items, featured products or promotions. You can choose to stop receiving marketing emails from us at any time by requesting to unsubscribe to emails by clicking on the "unsubscribe" link on any email received. Please allow a few days for us to process your request

13. Content Ownership and Permission to Display

Mindario does not claim ownership rights to your content, including your photos, stories or other materials posted by you on the Service. By submitting content to the Service, you are granting Mindario a world-wide, royalty-free and non-exclusive license to display, reproduce and publish your content on the service or related third party social networks or content sharing services per the settings you have selected in the Service and per this Privacy Policy.

14. Changes to the Privacy Policy

This Privacy Policy was updated on July 20, 2018. We reserve the right to change, modify or amend this policy at any time. Use of the Mindario Service after modification implies that you consent to this Privacy Policy as modified.

15. Who at the company is responsible for keeping my data safe?

Mindario employs a Data Protection Officer who follows the legal and regulatory data privacy policies of the US, EU, and UK.  The Mindario DPO also updates and enforces this Privacy policy and may be contacted at support@mindario.com.
